TERMS AND CONDITIONS OF THE "FREEMAN T. PORTER" CONTEST

Article 1 — Organizing Company
DS 55, a simplified joint-stock company (société par actions simplifiée) with a share capital of 1,000,000 euros, registered with the RCS under SIREN number 815 054 655, having its registered office at 1 B rue de Saint-Louis, ZAC Sud, 57150 Creutzwald, France, hereinafter referred to as the "Organizing Company", is organizing a free contest with no obligation to purchase for the Freeman T. Porter brand, entitled "Freeman T. Porter Contest", hereinafter referred to as the "Game".
The Game is accessible exclusively online on the Freeman T. Porter website at the following address: https://www.freemantporter.com/.

Article 2 — Game Dates
The Game runs from September 5, 2026 at 10:00 AM to September 8, 2026 at 11:59 PM, Paris time included.
Any entry registered before or after these dates and times will not be taken into account.

Article 3 — Conditions of Participation
The Game is open to any adult natural person residing in the European Union, having internet access and a valid email address.
To validly enter the Game, the participant must subscribe to the Freeman T. Porter newsletter upon entering and agree to receive commercial communications from the brand by email.
The participant must still be subscribed to the newsletter and have an active email opt-in status on the day of the random draw, i.e., September 9, 2026. Any unsubscription from the newsletter or withdrawal of email consent before this date will result in the invalidation of the entry.
Excluded from participation are members of the staff of the Organizing Company, its affiliates, its service providers who participated in the organization of the Game, as well as members of their families living under the same roof.
Participation is limited to one entry per person throughout the duration of the Game. Any multiple, incomplete, fraudulent, automated entry, or entry completed using inaccurate information may be canceled.

Article 4 — Modalities of Participation
To participate, the participant must, during the duration of the Game:

  • Go to the website https://www.freemantporter.com/.
  • Access the entry form provided in the Game's pop-up window, in the newsletter subscription module located in the footer of the Site, or on the payment page, by checking the box dedicated to newsletter subscription.
  • Enter their email address.
  • Indicate, where applicable, the collection(s) they wish to receive: Women and/or Men.
  • Validate their entry by clicking on the participation button.

No purchase is necessary to participate in the Game.
The Organizing Company reserves the right to verify the eligibility of the participant, the validity of their email address, and their email opt-in status. Any incomplete, fraudulent, automated entry, or entry not complying with these terms and conditions may be canceled.

Article 5 — Designation of the Winner
The winner will be designated by a random draw from all valid entries received during the duration of the Game.
The draw will take place on September 9, 2026. Only participants still subscribed to the Freeman T. Porter newsletter and having an active email opt-in status on this date will be included in the draw.
As chance determines the winner, no claim regarding the result of the draw will be accepted, except in the case of a proven material error.

Article 6 — Prize Offered
The prize offered is as follows:

  • A Freeman T. Porter gift card with an indicative commercial value of €300 incl. VAT, usable on the website https://www.freemantporter.com/, according to the conditions of use applicable to Freeman T. Porter gift cards.

Only one winner will be designated.
The prize is personal, non-transferable, non-exchangeable, and may not give rise to any financial consideration, reimbursement, exchange, or delivery of its value in cash, in whole or in part.
The Organizing Company reserves the right to replace the prize with a prize of equivalent or greater value if circumstances so require.

Article 7 — Winner Information and Delivery of the Prize
The winner will be contacted by email at the address provided upon entry, within 2 days following the draw.
The winner must respond within 4 calendar days from the dispatch of the email informing them of their win, in order to confirm their acceptance of the prize.
Failing a response within this period, or in the event of an invalid email address, incomplete information, or established ineligibility, the winner will be deemed to have forfeited their prize. The Organizing Company may then proceed with a new random draw.
The gift card will be sent to the winner by email or made available to them according to the procedures communicated by the Organizing Company.

Article 8 — Free Participation
Participation in the Game is free of charge and with no obligation to purchase.
Costs related to the internet connection to participate in the Game remain the responsibility of the participant.

Article 9 — Personal Data
Personal data collected as part of the Game are processed by DS 55, acting as data controller, for the purposes of managing entries, verifying eligibility, checking email opt-in status, designating the winner, awarding the prize, managing potential claims, and, subject to the participant's consent, sending commercial communications regarding Freeman T. Porter.
The data collected are:

  • email address;
  • consent to receive Freeman T. Porter newsletters and commercial communications;
  • active or inactive email opt-in status;
  • date and time of registration;
  • declared collection preferences: Women and/or Men;
  • technical data strictly necessary for the operation of the form and fraud prevention, where applicable.

Subscribing to the Freeman T. Porter newsletter is a condition for participating in the Game. The participant must remain subscribed to the newsletter and maintain an active email opt-in status until the day of the draw, i.e., September 9, 2026. Any unsubscription or withdrawal of email consent before this date will result in the invalidation of their entry.
Data used for sending newsletters and commercial communications are kept until the participant withdraws consent or unsubscribes.
The participant can unsubscribe at any time via the unsubscription link present in Freeman T. Porter emails. They also have the right to access, rectify, erase, limit, object to, and, where applicable, ensure the portability of their personal data.

Article 10 — Liability
The Organizing Company shall not be held liable in the event of a malfunction of the Internet network, the site, the pop-up window, technical tools used, or any event beyond its control preventing the proper conduct of the Game.
The Organizing Company reserves the right to shorten, extend, modify, postpone, suspend, or cancel the Game if circumstances so require, notably in cases of force majeure, fraud, technical problems, or any cause beyond its control. Its liability cannot be engaged as a result.

Article 11 — Fraud
Any fraud, attempted fraud, use of automated processes, creation of false identities, multiple entry, or circumvention of the Game's modalities will result in the immediate disqualification of the participant concerned.
The Organizing Company reserves the right to cancel all or part of any suspicious entries and, where applicable, prosecute the perpetrators of fraud.

Article 12 — Acceptance of the Terms and Conditions
Participation in the Game implies full and complete acceptance of these terms and conditions.
The terms and conditions are accessible throughout the duration of the Game on the website https://www.freemantporter.com/ or via the link displayed in the Game's pop-up window.

Article 13 — Modification of the Terms and Conditions
The Organizing Company reserves the right to modify these terms and conditions if necessary, subject to informing participants by any appropriate means. Any modification will be deemed an integral part of the terms and conditions.

Article 14 — Applicable Law and Claims
These terms and conditions are subject to French law.
Any claim regarding the Game must be sent to the Organizing Company no later than 2 days following the end of the Game, via Customer Service.
In the absence of an amicable agreement, any dispute will be submitted to the competent courts in accordance with the rules of common law.
